General rules of conduct
We see the busily.online social community platform as a digital place for dialogue and the exchange of knowledge among each other. We therefore ask you to observe the following rules of conduct:
- busy.online is a community platform. Community means that we pursue common goals. The overarching goal of the LebensGestalter is "to be successful together". We achieve this through the exchange of knowledge and experience between community members in their various areas of interest and expertise.
- Communication on busily.online is polite, at eye level and ideally friendly. We will not tolerate individual insults or entire shitstorms on busily.online. Every member has the opportunity to report any misconduct directed against him/herself in all posts. The team of administrators and moderators will evaluate each individual case of misconduct and deal with it accordingly. In the case of serious breaches of these terms of use, this can go as far as losing membership and the associated exclusion from participation in the busily.online social community platform.
- Every member has the possibility to contact other members via their personal profile or via an organization profile. Community means networking. Networking in turn means communication and dialogue. We therefore ask all members to help new members get started, to quickly find their way around busily.online and to support each other.
- Please use labels when creating new content in the form. Labels help us to identify which topics are interesting and important to you. If there is no descriptive label for your content, put a hashtag (the "#" sign and then a descriptive term without spaces) in your post where possible. This automatically saves the term in the Keywords module. If many members keep using the term, it will soon be included in the labels.
- Where possible, please provide as much information as you can about yourself and your interests. Skills in your personal profile show, for example, other members where you have special knowledge and skills and can also be liked and thus confirmed by acquaintances.
- Use the opportunities to interact, be it liking, commenting, befriending or simply following someone interesting, etc., to stay informed of new posts by the person or organization. By doing so, you help turn active members into community experts, because every interaction is rewarded with points for the contributor. If enough points are received, sponsoring members can subsequently be promoted to experts. As a community expert, you have the opportunity to set up and manage your own micro-community on your own expert topic.
- Invite people to participate on busily.online who you think will benefit from the community platform and who can also contribute to making us successful together. Regardless of whether you are interested, have a hobby or work - everyone who would like to be active together with others is welcome on busily.online. Use the invitation function via email template from busily or copy the invitation link into your personal message from your own email account.
Legal Terms of Use
1. Scope of Terms of Use
- These terms of use apply to the online service busily.online Social Community Platform, which can be accessed on the Internet at busily.online. This is a platform on which users can create profiles.
- You can access the currently valid Terms of Use at busily.online/terms.
2. Conclusion of contract and user account
- By completing the online registration process and creating a profile, a user contract is concluded with the operator, the association Die LebensGestalter. The subject of the contract of use is the free use of the profile.
- Creating a profile (standard membership) requires the free creation of a user account. This consists of a user name and a password (“log-in data”).
- The creation of a user account is only possible if the user provides a current e-mail address. This e-mail address is also used for communication with the operator.
- The user assures that the data used when creating his profile ("profile data") is correct and complete. The use of pseudonyms is not permitted.
- Contract language is exclusively German.
- In the case of any communication between the user and other users, any contractual relationships arise exclusively between the users involved. The operator is neither a representative nor does he himself become a contractual partner.
- Paid support of the association by subscribing to a one-year supporting membership enables the use of additional functions and modules of the platform. A completed subscription does not mean automatic membership in the association Die LebensGestalter. Membership as a supporting member is only complete once the subscriber joins the organization profile of the Die LebensGestalter association.
3. Use of Profile
- When using the profile, the user can use various services:
- The user has the option of publishing their own content (text, images, etc.) on the platform.
- The user has the option of sending messages to other users.
- The user has the option of sharing their own content and that of others on external social media, whereby a backlink to the original content on busily.online is automatically generated.
- The operator is entitled to block access to individual content at any time, e.g. if there is a suspicion that it violates applicable law or the rights of third parties. The user is not entitled to the maintenance of individual functionalities of the platform.
- The operator endeavors to ensure trouble-free operation of the platform. This is naturally limited to services over which the operator has an influence. The operator is at liberty to restrict access to the platform in whole or in part, temporarily or permanently, due to maintenance work, capacity issues and other events that are beyond his control.
4. User's duty to cooperate: posting content
- The user undertakes to observe applicable law (e.g. criminal, competition and youth protection law) when creating and using their own content and not to infringe any third-party rights (e.g. rights to names, trademarks, copyrights and data protection).
- The user undertakes to the operator that any content posted on the platform does not violate applicable law or morality either in terms of its content or its form. The same applies to setting external links. In particular, it is not permitted to distribute content that
- racism
- Glorification of violence and extremism of any kind
- Calls for and incitement to criminal offenses and violations of the law, threats to life, limb or property
- Hate speech against people or companies
- Personally injurious statements, defamation, defamation and slander by users and third parties as well as violations of the law on fair trading
- copyright infringing content or other intellectual property violations
- sexual harassment of users and third parties

- depicts, relates to or contains offensive, sexist, obscene, vulgar, hateful or disgusting material and language.
- Content protected by copyright may only be included verbatim in contributions without the consent of the respective rights holder within the framework of the applicable citation law. Quotations are to be marked by highlighting using the citation function and citing the source. In particular, posts that are not quoted correctly can be removed or corrected by the moderators. The distribution and/or public reproduction of any content of the portal without the consent of the operator is prohibited.
5. Other obligations of the user to cooperate
- The user may use the platform for private and professional purposes and advertise for himself or third parties, provided that the user himself or someone the user represents is liable for the advertised service or offer. However, contributions or direct messages with advertising content are strictly prohibited without the consent of the operator and the recipient (in particular: spam messages).
- In the event that the user uses the opportunity to inform third parties about the existence of the platform via the invitation function provided by the operator, he must ensure that the third party agrees to the sending of the advertising invitation e-mail.
- In the event that the content contains hyperlinks to third-party sites, the user assures that he has the right to use the hyperlink and that the website to which reference is made ("landing page") is compatible with applicable law and the rights of third parties.
- The user is obliged to handle the log-in data carefully. Without exception, the user is prohibited from disclosing the log-in data to third parties and/or allowing third parties to access the profile by bypassing the log-in data.
- The user must refrain from any activity that is likely to impair and/or excessively burden the operation of the platform or the technical infrastructure behind it. These include in particular:
- the use of software, scripts or databases in connection with the use of the portal;
- the automatic reading, blocking, overwriting, modifying, copying of data and/or other content, insofar as this is not necessary for the proper use of the platform;
- It also violates privacy and is therefore not permitted to remove the anonymity of other users or to disclose information from other users from private messages, e-mails or chats that are not intended for the public. Users may not include any information in their posts or make it known in any other way that could reveal the identity of another user or that the user has received from other users exclusively in private messages, e-mails or chats.
- If disruptions occur when using the portal or its functionalities, the user will inform the operator of this disruption immediately. The same applies if the user obtains information about content published by third parties that obviously violates applicable law or the rights of third parties.
6. Use Rights
- The user grants the operator a spatially and temporally unrestricted, irrevocable, transferable, non-exclusive, free right to exploit the content posted in the online offer. The operator is entitled to use, edit and exploit the content at any time. This includes in particular the right of reproduction, the right of distribution and the right of public reproduction, in particular the right to make publicly available. The user waives the right to name the author. This regulation does not affect the user's ability to grant third parties rights to content posted according to specific license models.
- All rights to the content of the platform are owned by the operator. The reproduction, distribution and/or publication of content that the operator, other users or third parties have posted on the platform is permitted, taking into account the conditions to be observed in point 4.
7. Liability
- Unlimited liability: The operator has unlimited liability for intent and gross negligence as well as in accordance with the Product Liability Act. For slight negligence, the operator is liable for damage resulting from injury to life, limb and health of persons.
- The following limited liability also applies: In the event of slight negligence, the operator is only liable in the event of a breach of a material contractual obligation, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the user can regularly rely (cardinal obligation). The amount of liability for slight negligence is limited to the damage that was foreseeable at the time the contract was concluded and the occurrence of which must typically be expected. This limitation of liability also applies to the vicarious agents of the operator.
8. Right to Indemnification
The user indemnifies the operator and his employees or agents against all resulting third-party claims in the event of a claim for alleged or actual violation of rights and/or violation of third-party rights through actions taken by the user in connection with the use of the platform. In addition, the user undertakes to reimburse all costs incurred by the operator through claims by third parties. The reimbursable costs also include the costs of an appropriate legal defense.
9. Personal Data
- The user hereby consents to the storage of the personal data entered by him. This also applies to the storage of the IP addresses that are transmitted each time the portal is used. In particular, the user also agrees to the presentation of the personal data he has entered in his profile within the portal for other users of the portal and third parties who are not users of the portal.
- The user also agrees to the use of his personal data for the personalization of content placed on the platform. There is no automated use for advertising activities on or off the platform.
- The use of the platform makes the collection, processing and use of personal data by the operator unavoidable. The operator assures that all stored data will be treated with care and will only be processed within the scope of the user's data protection consent. The operator does not use personal data beyond this.
- The user further agrees that the operator may use the user's personal data for direct marketing purposes on the platform. This includes advertising to the user via e-mail and other communication options on the platform. Use by third parties is not possible.
10. Term/Termination
- The contract runs for an indefinite period and can be terminated by either party at any time without observing a notice period and giving reasons by deleting the user profile from the user or the operator.
- The one-year subscription period expires automatically if the subscription is not renewed by the user. The operator will inform the subscriber about the process in a timely manner. A termination of the annual subscription is only possible for good cause for termination by both parties.
- There is an important reason for the operator to terminate this contract if the user sustainably violates his obligations under Section 4 or 5 of this contract. The termination of association sponsoring members (extraordinary members) must also be decided by the association board.
11. Final Provisions
- Should the contract contain invalid regulations, the validity of the rest of the contract remains unaffected.
- Austrian law is exclusively applicable to this contract. Place of jurisdiction is Salzburg.
